“The Last Exorcism” is one of the scariest movies to come along in a long time — until the last five minutes or so, when it completely falls apart.

Really, that’s about how quickly it all collapses. Director Daniel Stamm’s faux documentary starts out with deadpan delivery and a dry sense of humor, then it turns riveting, then truly frightening, then just plain silly. Writers Huck Botko and Andrew Gurland didn’t know where to go, so they went over the top.

Until then, the filmmakers keep you guessing as to what’s real and what’s imagined, what’s a disturbing mental disorder and what’s actually demonic possession. And the fact that this Eli Roth production uses all unknown actors helps us get sucked into this eerie world.

The Common Thread: Diversion in the Jurisprudence of a Century of Juvenile Justice
A central objective of those who created the juvenile court was to protect young delinquents from the destructive punishments of the criminal justice system. This promotion of juvenile court as a diversion from criminal justice is distinct from more ambitious programs of “child saving” intervention because avoiding harm can be achieved even if no effective crime prevention treatments are available. This essay shows diversion has been an important motive in juvenile justice from the beginning, and the dominant purpose of a separate juvenile court since In Re Gault in 1967. The past thirty years have been the juvenile court’s finest hour as a diversion project; the rate of juvenile incarceration has been stable, while incarceration of young adults has soared.

The circumstances of public discourse about guns in the late 1960s were rich in sentiment and almost completely lacking in empirical data. Questions of firearms control were only episodically important at the national level, and the administration of federal gun laws was of minuscule importance prior to 1968.

Executions, Deterrence and Homicide: A Tale of Two Cities
We compare homicide rates in two quite similar cities with vastly different execution risks. Singapore had an execution rate close to 1 per million per year until an explosive twentyfold increase in 1994-95 and 96 to a level that we show was probably the highest in the world. Then over the next 11 years, Singapore executions dropped by about 95%. Hong Kong, by contrast, has no executions all during the last generation and abolished capital punishment in 1993. Homicide levels and trends are remarkably similar in these two cities over the 35 years after 1973, with neither the surge in Singapore executions nor the more recent steep drop producing any differential impact. By comparing two closely matched places with huge contrasts in actual execution but no differences in homicide trends, we have generated a unique test of the exuberant claims of deterrence that have been produced over the past decade in the U.S.

Investigating the Continuity of Sex Offending: Evidence from the Second Philadelphia Birth Cohort
This study uses data from the Second Philadelphia Birth Cohort to examine the natural history of sex offenders and their involvement in sexual offending through age 26. Several key findings emerged from our effort. First, only one in ten of the 221 male and female juvenile sex offenders had a sex-related offense during the first eight years of adulthood. Second, 92% of all the cohort males with adult sex records had no prior juvenile sex offense. Third, a boy with no sex contacts but five or more total juvenile police contacts was more than twice as likely to commit a sex crime as an adult as a juvenile sex offender with fewer than five total police contacts. Fourth, multinomial logistic regression results demonstrated that being a juvenile sex offender did not significantly increase the likelihood for an individual being an adult sex offender nor did the frequency of juvenile sex offending. In short, the assumptions underpinning current registration and notification laws are fraught with problems and should be re-considered.

Finding a Ceiling in a Circular Room: Locke v. Davey, Religious Neutrality, and Federalism
The text of the U.S. Constitution clearly distinguishes religion from non-religion by providing that while Congress may pass laws concerning many subjects and prohibiting many things, it may not make laws respecting the establishment of religion or prohibiting religious exercise. As the distinctiveness of religion is clear from the text, the Court has had no problem concluding that religion, as a subject matter, and religious believers, as a class of persons, are constitutionally distinct. Though not apparent from the text, it is equally clear, and equally settled, that the Religion Clauses tug the government in opposite directions. Noting this tension, the Court has tread the line between the clauses carefully, holding that if the government opposes the establishment of religion too vigorously it will burden religious exercise, and if the government seeks to accommodate religious exercise too liberally, it will establish religion. However, while these propositions — that religion is distinct and that there is tension between the Religion Clauses — are clear and settled, the Court has struggled mightily to reconcile them. That is, the Court has not been able to answer the following question: how differently may the government treat religion from non-religion under one clause without violating the other?This article attempts to answer that question. My answer is inspired and informed by Locke v. Davey, 540 US 712 (2004), a case in which the Court held that at least in certain contexts the Free Exercise Clause permits the government to exclude an individual from a funding program on the basis of religion. In answering this question, I hope to accomplish three goals: (1) to defend the holding and reasoning in Davey; (2) to assuage the concerns of Davey’s critics; and (3) to develop a paradigm that grants states discretion over how they partner with religious organizations but still limits states in a way that is consistent with the guarantees in the Religion Clauses. Given the extensive criticism of the Davey opinion, and the normative and practical significance of the question addressed in this article, this analysis is particularly timely and important.
